TERMS & CONDITIONS

1. Scope of Application

The following terms and conditions of business of WynnUSA (hereinafter referred to as “supplier”) apply to all agreements concluded between customers and WynnUSA via the online shop at www.wynnusa.com (hereinafter also referred to as “e-shop”). Unless otherwise agreed, these terms shall override any terms and conditions used by the customer. A consumer refers to a natural person who is acting primarily for purposes which are not related to his/her trade, business or profession. Customers who are not consumers are kindly requested to contact the supplier by e-mail (bwynn@wynninnovations.com).

2. Conclusion of Contract

The following terms and conditions regarding the conclusion of contract apply to orders placed via our e-shop www.wynnusa.com

The presentation of goods in our e-shop does not constitute a legally binding offer on our part but is instead a non-binding invitation to consumers to order such goods. When ordering the desired goods, the consumer submits a binding offer by concluding a purchase agreement.

When an order is received in our e-shop, the following rules apply: the consumer submits a binding offer of a contract by successfully completing the designated order process in our e-shop.

3. Terms of delivery

Delivery is tracked and made through DHL/FedEx/Emirates Post or any other equivalent courier service.

       United States - USD 7

Unless stated otherwise, the goods will be shipped out within 2 to 4 working days.

If not all products ordered are in stock, we will contact the customer to provide either a later delivery or other available comparable products with same value. In case the client will not accept one of these options; we will reimburse the payments already made, immediately.

Should it not be possible to deliver the goods due to a fault on customer’s part, despite three delivery attempts, we may withdraw from the contract. The value of the product will be reimbursed minus shipping costs and any other costs incurred during delivery attempts and returns. We reserve the right to not reimburse the value of the product if the extra costs exceed its value.

It is the costumer’s responsibility to bare the import costs if any. WynnUSA is not liable and will not offer any refunds if the goods are not retrieved from customs by the customer.

Cancelations

Consumers have a right of cancellation within 14 days of receiving the goods without stating the reason for the return, by email to bwynn@wynninnovations.com or by post to the following address: 20449 Barton Rd, Pinckney, Mi 48169 USA. with your order number, name, address and e-mail.

To comply with the cancellation period, it is sufficient if you send the message regarding the exercise of your right of cancellation before the cancellation period expires. If you cancel this contract, we undertake to refund all payments we have received from you (not including delivery charges).

For this refund, we use the same payment method that you used for the original transaction.

The refund will be executed once the goods are returned in satisfactory, new condition. All return costs are the responsibility of the consumer.

WynnUSA is not responsible if the goods are lost during return shipping. That is why it is strongly advised to return the goods through a tracked mailing service of your choice.

The right of cancellation does not apply in the case of goods that are not suitable for return for hygiene reasons.

Obvious signs of use, such as make-up or lipstick marks, odor, removed labels, etc. are clear indications of use.

All returned goods MUST be unused and returned in their original conditions and packaging.

Please note that for a cancellation we require a clear statement from you (e.g. letter or e-mail) stating that you would like to return the goods. Please place the items in their original condition in a parcel, with a copy of your cancellation letter including your order number, name, address and telephone number.

WYNNUSA DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR PROVIDED BY A THIRD PARTY THROUGH OR IN CONNECTION WITH THE WEBSITE OR ANY HYPERLINKED WEBSITE OR SERVICE.

WYNNUSA MAKES NO REPRESENTATIONS CONCERNING ANY CONTENT CONTAINED IN OR ACCESSED THROUGH THE WEBSITE, AND WYNNUSA WILL NOT BE RESPONSIBLE OR LIABLE FOR THE ACCURACY, COPYRIGHT COMPLIANCE, LEGALITY OR DECENCY OF MATERIAL CONTAINED IN OR ACCESSED THROUGH THE WEBSITE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WYNNUSA, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS, SUCCESSORS AND ASSIGNS OF EACH, BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, PUNITIVE OR OTHER DAMAGES YOU OR OTHERS MAY SUFFER, INCLUDING DAMAGES FOR LOST REVENUE, LOST PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, SERVICE INTERRUPTION, LOST DATA OR CONTENT, COMPUTER DAMAGE, COST OF SUBSTITUTE SERVICES, INABILITY TO USE THE WEBSITE, PRIVACY LEAKAGE, OR ANY OTHER LIABILITIES OR LOSSES CAUSED BY THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON OUR WEBSITE OR SUCH OTHER WEBSITES, ANY SERVICES OR PRODUCTS OBTAINED THROUGH OUR WEBSITE OR SUCH OTHER WEBSITES, ANY BREACH OF THESE TERMS, ANY ACT OR OMISSION BY US OR OUR PERSONNEL, WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES HAS BEEN DISCLOSED IN ADVANCE OR COULD HAVE BEEN REASONABLY FORESEEN, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (WARRANTY, CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.

THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN WYNNUSA AND YOU.
